Terms of service

By creating an account, accessing, or using Dynamoi, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

If you use Dynamoi on behalf of a label, company, or other entity, you represent that you have authority to bind that entity to these Terms.

Dynamoi provides marketing software, campaign operations, smart links, reporting, audience workflows, distribution-related utilities, and related tools for artists, labels, and music teams.

Some surfaces are self-serve, while others involve managed operations on Dynamoi-controlled infrastructure, ad accounts, and integrations.

Dynamoi may provide free, no-credit-card public release pages and smart links through Play. Free Play pages are provided for release discovery, destination-link routing, aggregate click reporting, and promotion-intent capture.

Free Play availability is subject to fair-use, abuse-prevention, technical, and platform-integrity limits. Free access is not guaranteed to remain available forever, and Dynamoi may modify, suspend, unpublish, rate-limit, or discontinue free Play features where needed to protect the service, comply with law, resolve rights issues, or prevent abuse.

Creating a free Play page does not create a paid campaign, guarantee promotion, guarantee indexing, guarantee streaming-service availability, or guarantee any listener, save, follow, royalty, revenue, or campaign outcome.

You agree to provide accurate information, maintain the security of your credentials, and accept responsibility for activity associated with your account or invited team members.

Dynamoi may bill subscriptions, usage-based fees, one-time purchases, campaign budgets, campaign credits, media spend, managed-service fees, and other product-specific charges through Stripe or another billing provider. Unless a product-specific checkout, order form, or written agreement says otherwise, you are responsible for authorized charges, taxes, payment-processing fees, third-party pass-through costs, and media spend associated with enabled services.

Live campaign delivery, campaign credits, media spend, distribution submissions, publishing administration actions, and third-party pass-through costs are generally non-refundable once committed, delivered, submitted, or consumed, except where required by law or where a verified third-party refund is available and passed through.

If you believe a charge is unauthorized or incorrect, contact support promptly so we can review it before a bank dispute or chargeback is filed. Filing a chargeback does not cancel your subscription, stop campaign obligations, or waive amounts already committed, delivered, submitted, or consumed.

Dynamoi may use account, checkout, receipt, campaign, usage, support, IP, device, provider, refund, and communications records to investigate billing questions, fraud warnings, refund requests, disputes, and chargebacks, and may submit those records to Stripe, card networks, banks, service providers, or legal advisors when appropriate.

Payment failures may result in service interruption, suspension, or termination.

Dynamoi and its licensors retain ownership of the platform, software, design, documentation, and related intellectual property.

You retain ownership of your content, but you grant us the limited rights required to host, process, optimize, display, and distribute that content as part of the service.

You authorize Dynamoi to create, manage, optimize, pause, and modify campaigns on supported ad networks when those actions are part of the services you purchased or enabled.

We may intervene without prior notice to protect ad accounts, prevent fraud, address policy violations, or maintain platform integrity.

You may not use Dynamoi for fraudulent, misleading, infringing, harmful, or illegal activity, including stream manipulation, policy evasion, malware distribution, or abuse of third-party services.

You may not use Dynamoi or Play to impersonate artists, labels, rights holders, or services; claim releases without authority; publish misleading destination links; create phishing or malware destinations; inject unauthorized pixels or scripts; manipulate streams, saves, follows, clicks, reports, rankings, or analytics; evade ad-network or streaming-service policies; scrape or bulk-extract public pages; or use the service for spam, harassment, infringement, or deceptive promotion.

Dynamoi integrates with third-party services including Meta, Google, YouTube, Spotify, Apple Music, YouTube Music, Amazon Music, Deezer, Tidal, SoundCloud, Bandcamp, Odesli, Stripe, Feature.fm, and others. Your use of those integrations is also subject to each provider's own terms, privacy policies, and API rules.

Play pages may use third-party metadata, artwork, identifiers, and destination links from Spotify, Odesli, streaming services, or other sources. Dynamoi does not guarantee that third-party metadata, artwork, or destination links are accurate, complete, current, available, or authorized for every use case. You are responsible for reviewing the public Play page and destination links you publish.

If a third-party integration becomes unavailable or is revoked, associated Dynamoi features may stop working without liability to us.

You are responsible for the legality, accuracy, and rights status of your content. You grant Dynamoi a non-exclusive license to use that content as needed to operate, provide, and improve the service.

You represent that you have the rights, permissions, and authority needed to create, claim, manage, publish, or promote any artist, release, track, artwork, metadata, destination link, or related content you submit or connect through Dynamoi or Play. You may not create or claim Play pages in a misleading, impersonating, infringing, or unauthorized manner.

You grant Dynamoi a non-exclusive, worldwide, royalty-free license to host, display, reproduce, process, route, analyze, and otherwise use your submitted or connected content, Spotify-sourced release metadata, cover art, destination-service links, and related identifiers as needed to operate Play, maintain public release pages, provide aggregate reporting, process takedowns, and support promotion workflows.

Dynamoi may require review before publishing or continuing to host Play pages for high-profile, disputed, suspicious, or potentially unauthorized artist or release claims. We may request additional information showing authority to manage or promote a release.

At launch, a Spotify release may be associated with a single Dynamoi account. Collaborations, compilations, re-releases, label changes, ownership changes, or disputed claims may require manual review. Dynamoi may pause, reassign, merge, unpublish, or remove Play pages while reviewing a claim or resolving a conflict.

Public Play pages may include a takedown or report link. Dynamoi may remove, disable, redirect, or return a 410/tombstone response for pages that are reported, infringing, impersonating, abusive, misleading, abandoned, technically unsafe, or otherwise inconsistent with these Terms or platform integrity.

If you use Dynamoi distribution or publishing administration services, you represent that you control or are authorized to administer the relevant recordings, compositions, metadata, splits, artwork, payees, territories, and rights. You authorize Dynamoi and its providers to submit, administer, update, monetize, claim, collect, report, and otherwise process those materials as needed to provide the service.

Store, DSP, PRO, publisher, collection society, and administrator timelines, approvals, rejections, payment data, and royalty calculations are controlled in part by third parties and are not guaranteed by Dynamoi.

We process personal data as described in our Privacy Policy. You agree to obtain any consents required for data you submit or connect through third-party services.

When you click "Promote this release" or submit a promotion request from Play or the dashboard, Dynamoi may create a promote-intent record and use your account, contact, release, and campaign-context information to follow up about paid campaign options. No paid campaign starts unless you separately authorize the applicable purchase, budget, or campaign workflow.

We may release experimental or beta features. These are provided as-is, may change or disappear at any time, and may be subject to additional instability or limited support.

We aim for high reliability, but we do not guarantee uninterrupted availability. Maintenance windows, provider outages, rate limits, and force majeure events can affect performance.

Play analytics, click counts, country summaries, bot filtering, promote-intent reporting, campaign attribution, royalty benchmarks, and other reporting surfaces are provided for informational and operational use. They may be delayed, estimated, filtered, incomplete, or affected by third-party systems, bots, privacy controls, browser behavior, outages, or data-processing errors.

We may suspend or terminate access for violations of these Terms, non-payment, suspected abuse, or platform integrity concerns. You may stop using the service at any time, subject to your billing obligations.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

To the fullest extent permitted by law, Dynamoi is not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, revenue, data, or goodwill.

Our total liability is limited to the greater of $100 or the amount you paid to Dynamoi in the 12 months preceding the claim.

You agree to indemnify and hold harmless Dynamoi and its personnel from claims, liabilities, damages, losses, and expenses arising out of your use of the service, your content, or your breach of these Terms.

We may modify, suspend, or discontinue parts of the service at any time. Where practical, we will provide notice of material changes.

The service may include links to or dependencies on third-party services. We do not control those services and are not responsible for their content, policies, privacy practices, availability, metadata, artwork, or operations.

We may update these Terms as the business and platform evolve. Continued use of Dynamoi after updates take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of South Dakota, without regard to conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in South Dakota, unless a separate signed agreement with Dynamoi states otherwise.
